Ohio construction worker hit by a car on jobsite

The construction workers that labor on the roads and highways which traverse Ohio are particularly vulnerable to tragic accidents involving vehicles traveling on these roads. Recently, a serious workplace accident occurred when a construction worker was hit and inured by a passing car in West Alexandria, Ohio.

The construction worker was apparently placing traffic cones around a manhole on West Dayton Road in West Alexandria when he was struck by a car. It is reported that the car had just collided with another vehicle on the road before striking the worker. The worker was taken via helicopter to a hospital with noncritical injuries.

Anyone who is injured in a workplace accident is entitled to receive compensation for medical expenses and loss of wages, regardless of who is at fault. By filing a workers' compensation claim, employees can receive reimbursement for medical treatment for any injuries they may have sustained as a result of a workplace accident. They are also entitled to additional benefits if they are temporarily or permanently disabled as a result of an accident. Additionally, they may be compensated for any permanent physical impairment they are left with after receiving medical treatment.

In a serious case such as this one, it is also possible that an injured construction worker may have a valid negligence claim for personal injury against one or both of the drivers that crashed prior to the accident. It is possible that one or both of these drivers was negligent in the operation of their vehicles when they passed through the construction zone, or passed by the worker.

However, state laws on this issue vary. Accepting workers' compensation benefits may waive a person's right to file a civil claim, depending on who is ultimately responsible for the accident.
