Ohio truck driver dies following crash with another truck

Some recent posts here have discussed the tremendous hazards that Ohio transportation workers face. Those who work in the transportation industry are statistically more disposed to suffering from a workplace injury. This is due to the unsafe nature of our roads and highways. Recently, a 56-year-old Ohio man, who was driving a tractor trailer filled with a material used to produce asphalt, was killed as a result of a crash with another truck.

According to the reports, the 56-year-old truck driver swerved while attempting to pass another truck and struck the trailer of the other truck, causing his own truck to jackknife and then flip over and slam into a guardrail. The condition of the other truck driver was not immediately known. It is not clear from the initial reports what company the Ohio man was working for.

Workplace accidents can occur under all types of circumstances. Under Ohio's workers' compensation law, if this truck driver was working for an Ohio business at the time of the accident, his immediate family members may be entitled to receive death benefits as well as reimbursement for funeral, burial and medical expenses.

After a complete investigation of the accident, even if it is determined that the Ohio truck driver was negligent or is issued a citation for careless driving, family members of the deceased driver may still be eligible to receive death benefits under Ohio workers' compensation law. This is because anyone who suffers an injury while working is entitled to apply for workers' compensation benefits, regardless of fault.
