What is DWRF?

DWRF is an acronym that stands for Disabled Workers Relief Fund. This fund was created to assist injured workers who have been declared permanently and totally disabled whose compensation rates have not kept pace with inflation and the cost of living. DWRF eligibility is determined automatically for every injured worker who is declared permanently and totally disabled (PTD). No action on the part of the injured worker is needed. DWRF eligibility is based on the combined total of permanent toal disability and Social Security disability received by the injured worker. 

The Rights of the Injured Worker

Anyone who suffers a work-related injury in Ohio deserves to be treated fairly by BWC employees and to promptly receive the benefits to which he or she is entitled. BWC believes every employee injured at work should receive appropriate and coordinated care with a goal of returning to work and quality of life.

Will the Bureau of Workers' Compensation reimburse me for my travel expenses?

The Bureau reimburses a claimant for any actual and necessary expenses the claimant incurs in submitting to a medical examination or vocational evaluation scheduled by the Commission or the Bureau at a place other than the claimant's permanent or temporary residence. Travel expenses include the cost of transportation, lodging, and meals. The Bureau periodically issues a schedule detailing the reimbursement rates. The employer is required to pay the cost of any examination it initiates immediately upon receipt of the bill. This includes any fee charged by the physician, the cost of transportation and meals, and any wages an employed claimant lost on account of the examination. This rule applies to all claims, whether the employer is state fund, self-insuring, or non-complying. 

Finding and Choosing an Attorney for your Workers' Compensation Claim

Although there is no law which says you need to hire a lawyer, in practical terms and regardless of how you feel about attorneys, it is difficult to handle a workers' compensation case on your own. With trained adjustors working for the insurance companies who have lawyers at their everyday disposal, hiring a qualified attorney is essential. Unless your case is extremely simple, a good lawyer is important to protect your rights. Trying to handle your own case may save you a penny but cost you a pound in the long run.

The Workers' Compensation Bargain

The Workers' Compensation Act reflects a growing public sentiment that employees should receive compensation for work-related injuries and that compensation should be regarded as a charge upon the business in which the employee worked. Workers' compensation therefore attempts to accommodate the correlative rights and duties of employers and employees. Each party relinquishes certain common law rights and duties in exchange for the imposition of new statutory rights and duties.

Apportionment of death benefits

If there is more than one wholly dependent person at the time of the workers' death, R.C. § 4123.59(B) requires the Industrial Commission to apportion the award among all such dependents. The Industrial Commission may apportion the benefits "as it deems equitable in the circumstances of each particular case." The Commission has no obligation to make an equal apportionment among those claimants who were totally dependent upon the decedent. 

Residual Disabilities

Ohio Revised Code § 4123.52 provides the Commission with continuing jurisdiction to make modifications, changes, findings, or awards if written notice of a claim relating to the specific part or parts of the body injured or disabled has been given pursuant to § 4123.84 or 4123.85. This grant of continuing jurisdiction includes the power to award compensation or benefits for loss or impairment of bodily functions that develop in a part or parts of the body not specified under § 4123.84(A)(1) if the injury is residual to any injury of a body part as to which notice was properly given. A "residual" injury is one developing in a body part not originally alleged to have been injured. For example, a psychiatric condition that subsequently develops as a result of a knee injury qualifies as a residual injury. 

The compensation bargain

The Workers' Compensation Act reflected a growing public sentiment that employees should receive compensation for work-related injuries and that compensation should be regarded as a charge upon the business in which the employee worked. Workers' compensation in the state of Ohio therefore attempts to accommodate the correlative rights and duties of employers and employees. 

Filing an Application for Workers' Compensation Benefits

A workers' compensation award is the exclusive remedy for claims arising out of compensable injuries and diseases. For this reason, workers' compensation jurisdiction attaches only upon the filing of a claim application within the time prescribed by law. The claimant must file within the statutorily prescribed period; the filing of the claim application at any office of the Bureau of Workers' Compensation or with the Industrial Commission qualifies as the "receipt" of the claim for processing purposes. A claimant may effect a timely filing by mailing an application that is received by a Bureau employee responsible for receipt and distribution of Industrial Commission corespondence.
