In summer, many workers are vulnerable to heat illness

Today is the first day of July. Though it is still early summer, many parts of the country have already experienced intense heat waves. Those places that have not yet felt the full blast of summer soon will.

What is an intentional tort?

R.C. 2745.01 defines an intentional tort as occurring where an employee's injury occurred because the employer acted "with the intent to injure" or "with the belief that the injury was substantially certain to occur." The statute defines "substantially certain" to require "deliberate intent." An intentional tort can also occur if the employer deliberately removed a safety guard or misrepresented a hazardous or toxic substance.

Injured workers don't need to go at it alone

The Ohio Bureau of Workers' Compensation is the agency responsible for providing medical and wage replacement benefits to individuals who experience work-related injuries, disease or death. In the state of Ohio, workers have the right to make a claim for benefits if they experience a health concern because of their employment at a company. Self-inflicted injuries are not compensable

An employee's self-inflicted injuries are excluded from coverage under the workers' compensation fund. Deliberate self-injuries are highly unlikely to be motivated by the prospect of entitlement to workers' compensation benefits, because compensation law provides for an award based upon only a percentage of a workers' wages.
