Ohio construction workers in casino collapse file a lawsuit

Most Ohio residents will recall the horrific floor collapse at the Cincinnati construction site of an Ohio casino back in January of this year. Among other things, this collapse illustrates that workplace accidents at construction sites can cause very serious and sometimes even catastrophic injuries.

Under the workers' compensation laws in the state of Ohio, these four workers who suffered serious injuries in the accident are entitled to receive medical treatment for their injuries, regardless of fault. They are also entitled to receive workers' compensation benefits during the time that they are unable to work. If some or all of these workers suffered some permanent injuries as a result of this workplace accident they may be entitled to seek additional comsensation.

The Ohio workers' compensation system provides additional monetary benefits for injuries that cause a temporary or permanent disability. Although monetary compensation will not completely repair the loss caused by catastrophic workplace accidents, these benefits can certainly lessen the impact.

Although workers' compensation coverage is available regardless of whose fault an accident is, the Occupational Safety and Health Administration often performs investigations after accidents such as these to learn whether any preventable hazards existed.

Sometimes in construction workers' accidents such as this one, the workers may also be able to seek damages from the general contractor or possibly another party besides their employer based on a theory of negligence. Oftentimes, the results of the OSHA investigations can assist victims in proving negligence in court. In this lawsuit, the workers are claiming these general contractors were negligent in allowing the workers to pour concrete in rainy, unsafe weather conditions.
