Waiver of and Employes’ Rights to Participate in the Workers’ Compensation System is Prohibited

There are two exceptions to the rule against waiver of rights. First, a blind employee may waive the right to compensation when the injury or disability may have been directly caused by or due to the blindness. Second, an employee voluntarily participating in an employer-sponsored recreation or fitness activity is permitted to waive his or her rights to participate in the workers’ compensation system in the event of injury due to those activities. However, the employee must have signed the waiver prior to engaging in the activity.
