What are vocational experts and what role do they have at hearings?

A vocational expert is an impartial expert witness with training, experience, and knowledge of the current labor market, the jobs available in the national economy, and skills needed to perform specific jobs. Vocational experts are almost always called upon to testify at hearings before administrative law judges and their testimony plays a significant role in the judge's decision.

The Ins and Outs of Temporary Total Disability

"Total disability" means that the injured worker is unable to return to his or her former position of emloyment. A finding of temporary total disability, sometimes reffered to as TTD, does not require a showing of complete physical impairment; rather, TTD requires a showing that the injured worker is prevented from performing his or her regular job duties. 

Residual Disabilities

Ohio Revised Code § 4123.52 provides the Commission with continuing jurisdiction to make modifications, changes, findings, or awards if written notice of a claim relating to the specific part or parts of the body injured or disabled has been given pursuant to § 4123.84 or 4123.85. This grant of continuing jurisdiction includes the power to award compensation or benefits for loss or impairment of bodily functions that develop in a part or parts of the body not specified under § 4123.84(A)(1) if the injury is residual to any injury of a body part as to which notice was properly given. A "residual" injury is one developing in a body part not originally alleged to have been injured. For example, a psychiatric condition that subsequently develops as a result of a knee injury qualifies as a residual injury. 

Americans With Disabilities Act

The Americans with Disabilities Act (ADA) applies to all employers who have fifteen or more employees. Whether or not an injured worker is subject to protection under the ADA after the workers' compensation injury depends upon the type of injury sustained and whether or not he has a permanent disability. The definition of disability for workers' compensation and the ADA is construed differently by the laws and courts. Determining whether an individual who has a workers' compensation injury is also disabled under the provisions of the ADA can sometimes be a difficult and confusing situation. Since the ADA is relatively new and the courts are still interpreting this problem, it is wise to seek legal advice if in doubt.
