What to expect at your first workers' compensation hearing

Knowing what to expect at your first workers' compensation hearing is important in helping to understand how the workers' compensation process works. When a hearing is scheduled, it is scheduled because the parties to the claim (the injured worker, the Bureau of Workers' compensation, or the employer) do not agree over some aspect of the claim. The dispute can be a large issue (for example, should the claim be allowed in the first place?) or a smaller issue (for example, should a specific doctor's bill be processed under workers' compensation?).

The Hearing Process

Upon receiving a claim, the Industrial Commission is required to refer the file to an "appropriate district hearing officer" in accordance with rules adopted by the Commission under R.C.§ 4121.36. Th Ohio Administrative Code (OAC) identifies what an "appropriate district hearing officer " is. The OAC requires the scheduling of hearings before a district hearing officer from the Industrial Commission service office in the city nearest the claimant's residence, or for out-of-state claimants, from the service office nearest the claimant's home if the service office is within one hundred and fifty miles thereof, or in Columbus for those claimants who live more that one hundred and fifty miles for an Industrial Commission service office, unless otherwise directed.

Litigation beyond the Industrial Commission hearing process

Before further litigation proceedings can take place in the court system, the party must exhaust all administrative remedies first. This means going through the entire Hearing process at the administrative level which is explained in our earlier blog of February 25, 2015. Failing to do this will result in any further proceedings pursued in court to be dismissed. There are a few different types of appeals/actions that can be instituted after the administrative process has been exhausted:

Should I Agree to a Video Hearing for Social Security?

SSA allows for judges in other regions to handle claims and conduct hearings via video teleconference (VTC).  The benefit of the VTC hearings are that the SSA can try to eliminate its backlog of claims.  Thus, some claims may be scheduled for a hearing sooner than if the claimant states they want the in-person hearing.  Also, a VTC hearing could save Claimants some travel time as their local office may be equipped to handle VTC hearings when they would otherwise have to travel to a regional hearing office for an in-person hearing.  However, Claimants have the right to have an in-person hearing; they can't be forced into having one.  The benefits of having an in-person hearing are that they may allow the judge to better observe a claimant and their disabilities.  In addition, in-person hearings are more personal.  This personal contact could be the difference between approval and denial of benefits.  Contact the Bainbridge Firm for assistance with your Social Security claim. 

If I live out of state, where will my hearing be held?

Pursuant to Ohio administrative Code 4121-3-09(C)(8), hearings for injured workers who reside outside of the state of Ohio and are located more than one hundred miles from an Industrial Commission of Ohio (IC) service office will be held in Columbus, unless the parties of interest have agreed in writing to a change of venue. Other hearings before the IC or its hearing officers shall be at the places designated by the IC in the notices of hearing.
